What is Spousal Open Work Permit (SOWP)?

Open work permit in Canada allows the permit holder to work in Canada with any employer, with a few exceptions. Spouse, common-law partner or conjugal partner living in Canada currently being sponsored for permanent residence or an accompanying dependent child of the principal applicant may be eligible for open work permit.

 

In addition, the spouses and common-law partners of sponsored some international students may also be eligible for an open work permit.

Spousal Open Work Permit (SOWP) explained

A spousal open work permit allows the spouses of sponsors or spouses of foreign students at college or university to work for any eligible Canadian employer.

The spousal open work permit for skilled workers category is exempt from LMIA assessment under code C41, while the validity of the open work permit for spouses of foreign students usually coincides with the spouse’s study permit.

Apply for Open Work Permit as a Sponsored Spouse or Common-law Partner in Canada

You can apply for an open work permit if you’re one of the following:

  • a spouse, common-law partner or conjugal partner living in Canada who’s being sponsored for permanent residence
  • an accompanying dependent child of the principal applicant

 

When you apply for your open work permit, you must also be

  • in a genuine relationship with your sponsor
  • included in an application for permanent residence, and have an AOR letter confirming that your permanent residence application is being processed
  • living in Canada with your sponsor

Apply for Open Work Permit as a Spouse or Common-law Partner of a Student

Starting April 30, 2024, your spouse or common-law partner may be eligible for an open work permit if you have a valid study permit and you’re

  • studying in a master’s or doctoral degree program
  • participating in an eligible pilot program, or
  • studying in one of the following professional degree programs at a university:
      • Doctor of Dental Surgery (DDS, DMD)
      • Bachelor of Law or Juris Doctor (LLB, JD, BCL)
      • Doctor of Medicine (MD)
      • Doctor of Optometry (OD)
      • Pharmacy (PharmD, BS, BSc, BPharm)
      • Doctor of Veterinary Medicine (DVM)
      • Bachelor of Science in Nursing (BScN, BSN)
      • Bachelor of Nursing Science (BNSc)
      • Bachelor of Nursing (BN)
      • Bachelor of Education (BEd)
      • Bachelor of Engineering (BEng, BE, BASc)

    One of the main reasons spousal open work permits are refused is that the applicant is unable to demonstrate sufficient proof of their relationship to their eligible spouse.

    The processing time for Spouse Open Work Permit is one-four months.
